Acceptance of these terms
These Terms of Service govern your use of The Ounce website and app. By creating an account, placing an order, or otherwise using our services, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use our services.
Eligibility and age requirement
You must be at least 21 years old to use our services. At pickup, you must present a valid, unexpired government-issued photo ID that matches the name on the order. We will refuse to release any order if the ID cannot be verified or if the person picking up is under 21.
Medical customers may be required to present a valid physician's recommendation or state medical ID card, as required by California law.
Your account
- Provide accurate, current information and keep it up to date.
- Keep your password confidential. You are responsible for activity that occurs under your account.
- Accounts are personal and may not be shared, sold, or transferred.
- We may suspend or close accounts that violate these terms, provide false information, or are used for fraud or resale.
Orders and pickup
Orders placed through the app are reservations for in-store pickup only. We do not ship or deliver products. Payment is collected in store at the time of pickup.
- Availability: Menu inventory updates frequently but is not guaranteed. If an item becomes unavailable, we will let you know and may adjust or cancel your order.
- Pickup window: Orders not picked up by store close on the day they are marked ready may be cancelled and the products returned to inventory.
- Purchase limits: Orders are subject to daily purchase limits set by California law. We may reduce quantities or cancel orders that would exceed those limits.
- Right to refuse: We may refuse or cancel any order at our discretion, including suspected resale, fraud, or errors.
Pricing, taxes, and deals
Prices shown on our menu include applicable California cannabis excise tax and local sales tax unless stated otherwise. Final amounts are confirmed at checkout in store.
Deals and promo codes are subject to their stated conditions, are valid only while active, cannot be redeemed for cash, and generally cannot be combined unless stated. We may correct pricing errors, including after an order is placed, and may withdraw a deal or code at any time.
Returns
For safety and regulatory reasons, cannabis products cannot be returned once they leave the store. If a product is defective, bring it and your receipt back within 7 days, and we will review it for exchange in line with state regulations.
Notifications and messages
If you enable push notifications, we may send order updates, deal announcements, and store news to your device. You can turn them off at any time. Messages with our staff are for order-related questions and must remain respectful.
Acceptable use
When using our services, you agree not to:
- Purchase products for resale or for anyone under 21.
- Consume cannabis on our premises or in public places where it is prohibited.
- Interfere with, scrape, reverse engineer, or attempt to gain unauthorized access to the app or its systems.
- Impersonate others, submit false information, or harass our staff.
Health and safety
Cannabis has intoxicating effects and may be habit forming. Do not drive or operate machinery under its influence. Keep products out of reach of children and pets. Product descriptions, THC values, and effects are provided for information only and are not medical advice. Consult a physician if you are pregnant, breastfeeding, or have a medical condition.
Intellectual property
The app, our logo, design, and original content belong to The Ounce. Brand names, product images, and trademarks belong to their respective owners. You may not copy or reuse our content without permission.
Disclaimers and limitation of liability
Our services are provided “as is” and “as available.” We do not guarantee that the app will be uninterrupted or error free, or that menu information is always complete or current.
To the fullest extent permitted by law, The Ounce is not liable for indirect, incidental, or consequential damages arising from your use of our services. Our total liability for any claim is limited to the amount you paid for the order giving rise to the claim.
Governing law
These terms are governed by the laws of the State of California. Any dispute will be handled in the state or federal courts located in Los Angeles County, California.
Changes to these terms
We may update these terms from time to time. When we do, we will revise the “Last updated” date above. Continuing to use our services after an update means you accept the revised terms.
